1. Agreement to Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Netportal Solutions, LLC ("Company," "we," "us," or "our"), the operator of the Fish Drop mobile application ("App"). By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the App and delete it from your device.
2. Description of Service
Fish Drop is a fishing companion application that provides solunar-based bite forecasts, weather data, fishing maps, catch logging, social features, and fishing competitions. The App is provided strictly for informational and entertainment purposes only. No information provided by the App constitutes professional advice, safety guidance, or a guarantee of any outcome.
3. Eligibility
You must be at least thirteen (13) years of age to use the App. By using the App, you represent and warrant that you are at least 13 years old. If you are under 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
4. User Accounts & Security
You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to (a) provide accurate, current, and complete information during registration, (b) maintain and promptly update your account information, and (c) notify us immediately of any unauthorized use of your account.
We reserve the right to suspend, disable, or terminate any account at our sole discretion, with or without notice, for any reason, including but not limited to violations of these Terms.
5. User Conduct & Prohibited Uses
You agree that you will not:
- Use the App for any unlawful purpose or in violation of any applicable local, state, federal, or international law, including but not limited to fishing regulations, licensing requirements, and environmental laws
- Post, upload, or transmit content that is unlawful, defamatory, obscene, offensive, threatening, harassing, hateful, or that contains profanity or violates any person's rights
- Submit false, fraudulent, or misleading catch data, measurements, or photographs in competitions or the social feed
- Attempt to manipulate leaderboards, scores, rankings, or competition results through any means
- Impersonate any person or entity, including other users, the Fish Drop brand, or Company personnel
- Use automated systems, bots, scrapers, or any non-human means to access or interact with the App
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
- Interfere with or disrupt the integrity or performance of the App or its related systems
- Circumvent, disable, or otherwise interfere with security-related features of the App
Violation of this section may result in immediate termination of your account and, where applicable, referral to law enforcement authorities.
6. Fishing Competitions
Competitions hosted through Fish Drop are recreational in nature and operate on a catch-photo-release basis. By participating in any competition, you acknowledge and agree to the following:
- You are solely responsible for holding a valid fishing license for all waters in which you fish
- All fish must be caught legally in full compliance with all applicable local, state, and federal fishing regulations, including but not limited to catch limits, size restrictions, seasonal closures, and species-specific rules
- All fish must be handled with care, measured accurately, and released promptly and properly
- All photographs and measurements submitted must be genuine and unaltered
- You accept the final results and scoring as determined by the App's automated scoring system
The Company reserves the right, at its sole discretion, to (a) disqualify any participant, (b) flag, remove, or void any catch submission, (c) modify competition rules, or (d) cancel any competition at any time, for any reason, including but not limited to suspected fraud, cheating, or rule violations. The Company shall not be liable for any losses or damages arising from competition results, disqualifications, cancellations, or prize-related matters.
7. In-App Purchases
Certain features of the App require a "Pro" purchase. All purchases are processed exclusively through the Apple App Store or Google Play Store and are subject to their respective terms, conditions, and refund policies. The Pro upgrade is a one-time, non-refundable purchase that grants permanent access to premium features.
The Company does not process payments directly and has no ability to issue refunds. For purchase-related inquiries, disputes, or refund requests, please contact Apple or Google directly through their respective support channels.
8. Assumption of Risk
YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP AND ANY FISHING ACTIVITIES UNDERTAKEN IN CONNECTION WITH INFORMATION PROVIDED BY THE APP ARE AT YOUR SOLE AND EXCLUSIVE RISK.
Fishing is an inherently dangerous activity involving risks including but not limited to drowning, hypothermia, severe weather, watercraft accidents, wildlife encounters, slip and fall injuries, equipment failure, and sun exposure. You voluntarily assume all risks associated with fishing activities, regardless of whether you relied on information provided by the App.
The App provides weather data, marine alerts, and fishing conditions sourced from third-party providers (NOAA, Open-Meteo, USGS, and others). This data may be inaccurate, incomplete, delayed, or unavailable. The absence of a weather warning in the App does not mean conditions are safe. You are solely responsible for checking official sources and exercising independent judgment before engaging in any water-based activity.
9. Disclaimer of Warranties
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
The Company does not warrant that:
- The App will be available at all times, uninterrupted, secure, or error-free
- Weather data, bite forecasts, solunar calculations, marine warnings, or fishing conditions are accurate, complete, or current
- The App will meet your requirements or expectations
- Any information obtained through the App will be accurate or reliable
- Defects in the App will be corrected
All forecasts, bite scores, and condition assessments are algorithmic estimates based on mathematical models and third-party data sources. They are not predictions, guarantees, or professional advice.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
- Your use of or inability to use the App
- Any information, content, or data obtained from or through the App
- Any decisions made or actions taken based on information provided by the App
- Personal injury, bodily harm, death, or property damage of any nature arising from your use of the App or any fishing activity
- Unauthorized access to or alteration of your data or transmissions
- Competition results, scoring disputes, disqualifications, or prize-related matters
- Interruption, suspension, or termination of the App or your account
IN NO EVENT SHALL THE COMPANY'S TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT YOU PAID TO THE COMPANY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
11. Indemnification
You agree to indemnify, defend, and hold harmless the Company, its officers, directors, employees, agents, partners, suppliers, and affiliates from and against any and all claims, demands, actions, damages, losses, costs, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the App, (b) your violation of these Terms, (c) your violation of any third-party rights, (d) your fishing activities or conduct on the water, or (e) any content you post, submit, or share through the App.
12. Dispute Resolution & Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
Any dispute, controversy, or claim arising out of or relating to these Terms, the App, or your use thereof shall be resolved through binding individual arbitration administered under the rules of the American Arbitration Association ("AAA"). The arbitration shall be conducted by a single arbitrator in the State of Michigan.
Class Action Waiver: YOU AGREE THAT ANY ARBITRATION OR PROCEEDING SHALL BE LIMITED TO THE DISPUTE BETWEEN THE COMPANY AND YOU INDIVIDUALLY. TO THE FULLEST EXTENT PERMITTED BY LAW: (A) NO ARBITRATION SHALL BE JOINED WITH ANY OTHER PROCEEDING; (B) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE ARBITRATED ON A CLASS-ACTION BASIS; AND (C) THERE IS NO RIGHT OR AUTHORITY FOR ANY DISPUTE TO BE BROUGHT IN A PURPORTED REPRESENTATIVE CAPACITY ON BEHALF OF THE GENERAL PUBLIC OR ANY OTHER PERSONS.
Exception: Either party may bring an individual claim in small claims court if the claim qualifies.
13. User-Generated Content
You retain ownership of content you create, including catch photos, notes, and posts. By sharing content through the App's social features, you grant the Company a non-exclusive, royalty-free, worldwide, irrevocable, transferable, sublicensable license to use, display, reproduce, and distribute such content within the App and for promotional purposes related to the App. This license survives account deletion or termination with respect to content already used in promotional materials or cached in backup systems.
You represent and warrant that: (a) you own or have all necessary rights, licenses, and permissions to post any content you submit; (b) your content does not infringe any third-party intellectual property, privacy, or other rights; and (c) your content complies with these Terms and all applicable laws. You agree to indemnify and hold the Company harmless from any claims arising from your breach of these warranties.
We reserve the right to remove, modify, or restrict any user-generated content at our sole discretion, with or without notice, for any reason.
14. DMCA & Copyright
The Company complies with the Digital Millennium Copyright Act (DMCA). To report copyright infringement, submit written notice to support@netportal.solutions including: (a) identification of the copyrighted work; (b) identification and location of the infringing material; (c) your contact information; (d) a good faith statement that the use is unauthorized; and (e) a statement under penalty of perjury that you are authorized to act on behalf of the copyright owner. The Company reserves the right to remove allegedly infringing content without liability.
15. Anonymized Data
You acknowledge that the Company may collect, aggregate, anonymize, and commercialize data derived from your use of the App, including catch data, location patterns, species data, and fishing conditions, provided such data cannot reasonably identify you personally. This anonymized data may be licensed, sold, or shared with third parties including tackle manufacturers, fishing organizations, research institutions, and advertisers. You retain no ownership interest in anonymized or aggregated data.
16. Intellectual Property
Fish Drop, its name, logo, design, scoring algorithms, and all related intellectual property are the exclusive property of Netportal Solutions, LLC. All rights not expressly granted in these Terms are reserved. You may not copy, modify, distribute, sell, lease, or create derivative works based on the App or any of its components without prior written consent.
17. Termination
You may terminate your account at any time by using the Delete Account feature in the App's Settings. We may terminate or suspend your access immediately, without prior notice or liability, at our sole discretion, for any reason, including but not limited to a breach of these Terms.
Upon termination, your right to use the App ceases immediately. Sections that by their nature should survive termination shall survive, including but not limited to: Assumption of Risk, Disclaimer of Warranties, Limitation of Liability, Indemnification, Dispute Resolution, User-Generated Content, Anonymized Data, and Governing Law.
18. Modifications to Terms
We reserve the right to modify these Terms at any time at our sole discretion. Material changes will be communicated through the App or by posting the updated Terms on this page with a revised version number and "Last Updated" date. When material changes are made, existing users will be required to review and accept the updated Terms before continuing to use the App. If you do not agree to the modified Terms, you must discontinue use of the App.
19. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, United States, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms, you consent to the exclusive jurisdiction of the state and federal courts located in Michigan.
20. Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
21. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the App and supersede all prior agreements, representations, and understandings.
